Acceptance of these terms
These Terms of Service form a binding agreement between you and Hedgehog Software LLC, 30 N. Gould St. Ste R, Sheridan, WY 82801, United States, the company that operates Predict Match Day. By creating an account or using the service you accept these terms. You must be at least 13 years old to use the service and at least 18 years old, or the age of majority where you live, to make purchases. If you do not agree with these terms, do not use the service.
The service
Predict Match Day is a season long football prediction game with fixtures, scoring, leaderboards, private and public leagues, a virtual coin economy and optional paid seasonal league licenses. We may add, change, suspend or remove features, competitions or content at any time, including during an active season, and we do not guarantee that any feature will remain available.
No gambling and no prizes
Predict Match Day is a game of skill played for entertainment. It does not offer betting, wagering, real money prizes or anything of monetary value. Coins and power ups are virtual items with no cash value. Nothing on the platform is an invitation to gamble, and the service is void where such games are prohibited by law.
Accounts
You must provide accurate information, keep your credentials secure and not share your account. You are responsible for all activity under your account. You may hold only one account. We may refuse, suspend or terminate accounts at our reasonable discretion, including for breach of these terms, suspected fraud or risk to the platform or other users.
Fair play and prohibited conduct
You must not cheat, use multiple accounts, automate play, scrape the service, exploit bugs, manipulate scoring, harass other users or post unlawful, hateful or infringing content. We may investigate and take any action we consider appropriate, including adjusting points and coin balances, removing content, revoking licenses and banning accounts, without notice and without refund where the breach caused the termination.
Predictions and scoring
Predictions lock at the scheduled kickoff unless a permitted power up applies. Points are calculated from our published scoring rules using match results supplied by third party data providers. We may correct scoring errors, rescore affected matches and adjust leaderboards. Postponed, abandoned or invalidated matches are handled at our discretion. Our scoring decisions are final.
Coins and power ups
Coins are a virtual currency that can be earned in the game or purchased. Coins and power ups are a limited, revocable, non transferable license to use features of the service. They are not property, have no cash value, cannot be redeemed for money, credit or any monetary equivalent, and cannot be transferred between users or accounts. We may change the catalog, prices, earn rates and limits at any time, and we may adjust or reverse balances obtained through errors, bugs or abuse. Unused coins and power ups have no value when your account is closed, suspended or terminated.
Licenses and payments
Host league licenses are purchased with coins. Community league licenses and coin packs are purchased with money through our payment provider Stripe. Each license applies to one league and one stated competition season and ends with that season without automatic renewal unless we expressly state otherwise. Prices shown at checkout apply; prices for future seasons may change. You are responsible for applicable taxes. Capacity and features of each package are described on the pricing page. Completing a purchase creates a binding obligation to pay the displayed price.
No refunds
All coin purchases, Host league license purchases (coins), Community league license purchases (money), power ups and other digital content are final and non refundable. Digital items are delivered or made available immediately at purchase. By purchasing you expressly consent to immediate performance and acknowledge that, where permitted by law, you lose any statutory right of withdrawal once delivery has begun. We do not refund for unused coins, unused power ups, unused season time, dissatisfaction with scoring or features, season or fixture changes, account suspension or termination for breach of these terms, or any other reason, except where a refund is required by non waivable law. Chargebacks and payment disputes initiated without contacting us first may result in suspension of the account pending investigation. Statutory rights that cannot be waived remain unaffected.
User content
You keep ownership of content you post, such as feed posts, league names, descriptions and images. You grant us a worldwide, royalty free license to host, store, reproduce and display that content for operating and promoting the service. You warrant that you have the necessary rights and that your content is lawful. We may remove or refuse any content at our discretion. You are solely responsible for content you post, including in leagues you own or moderate.
Intellectual property and third parties
The service, including its software, design, branding and databases, belongs to us or our licensors and is protected by law. Football competition, club and player names, crests and logos are the property of their respective owners. Predict Match Day is not affiliated with, endorsed by or connected to any football league, club, federation or data provider. Match data and statistics come from third party sources and are provided without warranty of accuracy or availability.
Disclaimer of warranties
The service is provided as is and as available, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non infringement. We do not warrant that the service will be uninterrupted, error free or secure, or that fixtures, results, statistics or scores will be accurate or up to date.
Limitation of liability
To the maximum extent permitted by law, Hedgehog Software LLC and its officers, directors, employees and agents are not liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, data, goodwill, coins, power ups, leaderboard position or game progress. Our total aggregate liability for all claims arising from or relating to the service is limited to the greater of fifty US dollars (USD $50) or the amounts you paid us in cash (not coins) in the twelve months before the claim arose. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
Indemnity, governing law, disputes and changes
You will defend, indemnify and hold harmless Hedgehog Software LLC and its officers, directors, employees and agents from and against any claims, damages, losses, costs and expenses (including reasonable attorneys fees) arising out of your content, your use of the service, your purchases or your breach of these terms. These terms are governed by the laws of the State of Wyoming, United States, without regard to conflict of law rules. Except where mandatory consumer law in your country of residence requires otherwise, exclusive venue for disputes is the state or federal courts located in Wyoming, and you consent to personal jurisdiction there. You and we waive any right to participate in a class, collective or representative action to the fullest extent permitted by law. If any provision is unenforceable, the rest remains in effect. We may update these terms; material changes will be posted on this page with an updated date, and continued use after the effective date constitutes acceptance.
